These Terms of Use apply to your use of Buildably and the property and planning information provided through the platform. By using Buildably, you agree to these terms.
1. Purpose of Buildably
Buildably provides property and planning information to assist with preliminary assessment and understanding of a site.
Buildably does not provide a statutory planning certificate, planning permit, building approval, land survey, legal advice, engineering advice, financial advice or other professional advice.
The information provided by Buildably should therefore be used as a starting point for understanding a property rather than as a substitute for approvals or professional assessment.
2. Data sources, accuracy and currency
Buildably compiles and presents information obtained from available government, public and third-party data sources.
We take reasonable steps to present this information accurately; however, source information may change, contain limitations or require interpretation in relation to a particular property or development proposal.
Measurements derived from mapping or parcel data may also be approximate and should not be treated as surveyed title dimensions.
Where Buildably identifies an item as ‘Check with authority’ or ‘Depends on your proposal’, further information or assessment may be required before that matter can be relied upon.
3. Your responsibility when making decisions
Buildably is intended to help you understand property and planning information more easily.
Before making a material decision — including purchasing, selling, financing, designing, subdividing or developing a property — you should confirm relevant information with the responsible council, government authority, service provider or an appropriately qualified professional.
The suitability of a property for a particular development ultimately depends on the proposed development and the applicable planning, building and other requirements.
4. Liability and statutory rights
To the maximum extent permitted by law, Buildably is not responsible for loss or damage arising solely from reliance on information provided through the platform without appropriate independent verification.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or restricted.
Buildably does not guarantee that a particular development will be permitted, feasible or approved.
5. Permitted use and intellectual property
Buildably is provided for lawful personal and business use.
You must not reproduce, commercially redistribute, scrape, reverse engineer or systematically extract Buildably’s reports, interface, analysis or proprietary content except where permitted by law or with Buildably’s written permission.
Buildably retains ownership of its branding, software, report presentation, analysis framework and other proprietary materials. Rights in government and third-party source data remain with their respective owners.
